Yazo Eat Terms of Service (Version 1.0.0)

  1. Introduction

    Yazo Tech PTY LTD (“Yazo Eat,” “we,” “our,” “us”) is committed to protecting your privacy and providing a secure, seamless, and enjoyable experience on our platform. By using the Yazo Eat app or website, you agree to comply with the following terms and conditions. Please read these terms carefully.

  2. Legal Definitions
    • “Account”
      An account created by a User or Food Partner to access and use the Yazo Eat platform, including the app and website.
    • “App”
      The mobile application developed and operated by Yazo Tech PTY LTD, known as Yazo Eat.
    • “Australian Privacy Principles (APPs)”
      The principles set out in the Privacy Act 1988 (Cth) that govern the handling of personal information by Australian government agencies and organizations.
    • “Data”
      Any information collected, stored, processed, or used by Yazo Eat, including Personal Information, Usage Data, Location Data, and Device Information.
    • “Device”
      Any electronic device used to access the Yazo Eat platform, including smartphones, tablets, and computers.
    • “Food Partner”
      Any food truck, cafe, restaurant, or other food service provider that partners with Yazo Eat to offer their products through the platform.
    • “Location Data”
      Information collected about the geographical location of a User’s Device.
    • “Order”
      A request placed by a User for food or beverages through the Yazo Eat platform.
    • “Personal Information”
      Information about an individual that can be used to identify that individual, such as name, email address, phone number, and payment details.
    • “Platform”
      The collective services provided by Yazo Eat, including the app, website, and related services.
    • “Service”
      The Yazo Eat platform and all features, functionalities, and services provided through it.
    • “Service Providers”
      Third-party companies or individuals that provide services on behalf of Yazo Eat, such as payment processing and data analysis.
    • “Terms”
      The terms and conditions set forth in this Privacy Policy and the Terms of Service.
    • “Usage Data”
      Information collected about how the Yazo Eat platform is accessed and used, including IP addresses, browser type, pages visited, and time spent on pages.
    • “User”
      Any individual who accesses or uses the Yazo Eat platform, including both customers ordering food and Food Partners.
    • “We,” “Us,” “Our”
      Refers to Yazo Tech PTY LTD, the operator of Yazo Eat.
    • “Website”
      The website operated by Yazo Tech PTY LTD, accessible at yazo.com.au
    • “Zero Commission Fee”
      The policy of charging Food Partners 0% commission on pick-up orders, subject to change as per the terms set forth in this policy.
  3. Scope of Definitions

    These definitions apply throughout the Privacy Policy and Terms of Service, providing clarity and ensuring consistency in understanding and interpreting the terms used. By using the Yazo Eat platform, Users and Food Partners agree to be bound by these definitions and the terms that incorporate them.

  4. General Terms and Conditions
    1. Acceptance of Terms
      By accessing or using Yazo Eat, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.
    2. Changes to Terms
      Yazo Eat reserves the right to update or modify these terms at any time without prior notice. Your continued use of the service after any such changes constitutes your acceptance of the new terms. We will notify you of significant changes via email or app notification.
    3. Currency
      All transactions conducted on the Yazo Eat platform will be processed in Australian Dollars (AUD) as the default currency. This will be clearly indicated on the final confirmation screen before payment is completed.
  5. User Conduct
    1. Prohibited Activities
      Users must not engage in activities that are illegal, harmful, or interfere with the operation of the service. Users must not upload, post, or transmit any material that is defamatory, obscene, threatening, or otherwise objectionable.
    2. Account Responsibility
      You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to immediately notify Yazo Eat of any unauthorized use of your account or any other security breach.
  6. Account Management
    1. Account Creation
      Users must provide accurate and complete information when creating an account. You must not create an account for anyone other than yourself without permission.
    2. Account Termination
      Yazo Eat reserves the right to terminate accounts that violate these terms or are inactive for an extended period. Users may terminate their accounts at any time by contacting customer support.
  7. Payment and Refunds
    1. Payment Processing
      Payments are processed through third-party providers. Users agree to pay all charges incurred by their account. Yazo Eat is not responsible for any issues arising from third-party payment processors.
    2. Refunds
      Refund policies are subject to the terms of the restaurant or food service provider. Yazo Eat does not provide refunds but will assist in resolving disputes between users and food partners.
    3. Currency
      All transactions conducted on the Yazo Eat platform will be processed in Australian Dollars (AUD) as the default currency. This will be clearly indicated on the final confirmation screen before payment is completed.
    4. Limitation on Refunds
      Refunds issued through Yazo Eat are subject to the terms of the respective food partners. Yazo Eat disclaims any responsibility for refund processing or disputes. Refunds, if applicable, will be issued in AUD and may be subject to currency conversion fees if applicable.
  8. Limitation of Liability
    1. Disclaimer of Warranties
      Our services are provided “as is” without warranties of any kind, whether express or implied. Yazo Eat disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
    2. Limitation of Liability
      Yazo Eat is not liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the service. In no event shall Yazo Eat’s total liability exceed the amount you paid us, if any, for using our services.
    3. Indemnification
      Users agree to indemnify and hold harmless Yazo Eat from any claims, damages, losses, liabilities, and expenses arising out of their use of the service.
    4. Force Majeure
      Yazo Eat will not be liable for any failure to perform its obligations under these terms if such failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, pandemics, or interruptions in internet service.
  9. Intellectual Property
    1. Ownership
      All content and materials on our platform, including but not limited to text, graphics, logos, and software, are the property of Yazo Eat or its licensors and are protected by copyright, trademark, and other intellectual property laws.
    2. User-Generated Content
      Users grant Yazo Eat a non-exclusive, royalty-free license to use, reproduce, modify, and display any content they post on the platform.
  10. Privacy Policy
    1. Data Collection
      We collect personal information that you provide to us, such as your name, email address, phone number, and payment details. We also collect usage data, including IP addresses, browser type, pages visited, and other diagnostic data.
    2. Data Usage
      We use your data to provide, maintain, and improve our services, process orders, and communicate with you. We may share your information with third-party service providers who perform services on our behalf.
    3. Data Protection

  11. Food Partner Terms
    1. Partnership Agreement
      By partnering with Yazo Eat, food partners agree to comply with these terms and any additional terms specific to their partnership agreement. Food partners acknowledge that all transactions on the Yazo Eat platform will be conducted in Australian Dollars (AUD), and it is their responsibility to ensure that prices are set accordingly.
    2. Fees and Payments
      Yazo Eat charges 0% commission on pick-up orders. However, this rate can change at any time. Any changes will be communicated in advance. Payments will be made in Australian Dollars (AUD), and partners are responsible for any currency conversion fees if applicable. Yazo Eat reserves the right to charge additional fees for specific services or features, which will be communicated to partners in advance. Payment disputes will be handled according to the terms specified in the partner agreement.
    3. Order Fulfillment
      Partners are responsible for fulfilling orders promptly and maintaining food quality. Issues related to order cancellations, delays, and customer complaints must be addressed promptly.
    4. Marketing and Promotions
      All joint marketing efforts and promotions must be approved by Yazo Eat. Partners must use branding materials in accordance with Yazo Eat’s guidelines.
    5. Liability and Indemnification
      Yazo Eat’s liability for issues arising from partner operations is limited. Partners agree to indemnify Yazo Eat against any claims related to their operations.
    6. Compliance and Legal Requirements
      Partners must comply with all relevant health, safety, and food handling regulations. Partners must notify Yazo Eat of any changes in their operational status or contact details.
